A gestão democrática das cidades, o estatuto das cidades e o plano diretor no município de Itapetininga

Abstract

This work aims to study the democratic management of cities prescribed in the Law 10.257, of July 10, 2001 (Statute of the City), as well as the confection of the Itapetininga master plan and practices of democratic management of the city. As well is examined whether the elaboration of the plan attend the requirements of the Statute. The study begin with the democracy theme in the Federal Constitution of 1988, both direct and representative. Then the theme is retake in the study of Law 10.257, of July 10, 2001 , the City Statute. This chapter studies the concept of statute, its importance and directives given to municipalities. The next chapter analyzes one of instruments contemplated in the law, called Master Plans. Approached in this chapter a new model for master plan introduced by the law, where its implementation is mandatory, as well as the importance of popular participation in its preparation. Following the institution of democratic management of cities is studied. In this case reviewed the text of the law and the importance of the issue to the Statute and society. The methodology of the study consists of inductive, descriptive and qualitative research. The technique is the documentary research with analysis of bills, official and civil newspapers. The research raises data related to the Law of the Itapetininga Master Plan, public audience held in the city, popular councils and other administrative practices of democratic management. The study concludes with the answers to the research objectives, where are also discussed its limitations and new subjects of study.
