| Resumo: | A pesquisa está inserida no contexto dos estudos de indicadores de Desenvolvimento Sustentável (DS), no caso particular, relacionados a decisões judiciais. Na perspectiva da função jurisdicional, isto é, das decisões judiciais, os estudos ainda são incipientes, verificando-se, no entanto, que desde o ano de 2005 inúmeras decisões, especificamente no âmbito do Superior Tribunal de Justiça (STJ) e do Supremo Tribunal Federal (STF), vem sendo decididas em base ao princípio do Desenvolvimento Sustentável (DS). Observa-se assim, que a justiça exerce uma função social imprescindível para a concretização do DS, na qual, realiza o fortalecimento do Estado de Direito, das instituições e salvaguarda os Direitos Humanos e tantos outros direitos e princípios indispensáveis à concretização da sustentabilidade, por meio de suas decisões. No procedimento metodológico, utilizando-se a técnica da análise de dados qualitativos, por meio da análise de conteúdo, foi possível identificar os indicadores que emergem da função jurisdicional em termos de DS. A partir da regra da exaustividade, iniciou-se a busca dos acórdãos na base de dados do STJ e STF, cujo resultado foi um total de 184 acórdãos judiciais que contém em seus textos a palavra “Desenvolvimento Sustentável” e/ou “Futuras Gerações”. Já nos resultados, a partir da intersecção, por um lado, dos indicadores dos ODS e, por outro, dos fundamentos constantes nas ementas, relatórios, dispositivos dos acórdãos e votos analisados, foi possível concluir que indicadores de DS emergem das decisões judiciais do STJ e STF. |
| Abstract: | The research is inserted in the context of studies of Sustainable Development (SD) indicators, in this particular case, related to judicial decisions. From the perspective of the jurisdictional function, that is, of judicial decisions, studies are still incipient, noting, however, that since 2005 numerous decisions, specifically within the scope of the Superior Court of Justice (STJ) and the Supreme Court (STF), has been decided based on the principle of Sustainable Development (SD). It is thus observed that justice plays an essential social function for the realization of the SD, in which it strengthens the rule of law, institutions and safeguards Human Rights and many other rights and principles essential to the achievement of sustainability, for through its decisions. In the methodological procedure, using the technique of qualitative data analysis, through content analysis, it was possible to identify the indicators that emerge from the jurisdictional function in terms of SD. Based on the exhaustiveness rule, the search for judgments in the STJ and STF databases began, which resulted in a total of 184 court judgments that contain the word “Sustainable Development” and/or “Futures Generations” in their texts. In the results, from the intersection, on the one hand, of the SDG indicators and, on the other hand, of the grounds contained in the menus, reports, provisions of the judgments and votes analyzed, it was possible to conclude that DS indicators emerge from the STJ’s judicial decisions.
