| Resumo: | O Código Florestal Brasileiro - Lei Federal n° 12.651 de 2012 introduz alterações na legislação, estabelecendo regras gerais para áreas de Reserva Legal. O presente trabalho visou analisar as possibilidades advindas com Novo Código Florestal Brasileiro para a regularização da área de Reserva Legal e problemas relacionados à regularização da Reserva Legal. Nestes termos, o objetivo do projeto é analisar uma propriedade de uso consolidado presente no estado de São Paulo, município de Itirapina, de acordo com as determinações do Código Florestal. Para o trabalho foi feito estudo sobre o tipo de bioma na região e as exigências quanto à Reserva Legal, estabelecidas pela Lei Federal nº 12.651/2012, logo o percentual de reserva legal da propriedade em questão foi identificado a partir do cálculo de todas as áreas presentes na propriedade. Esse estudo foi realizado com o auxílio do QGIS Desktop with Grass versão 3. 14 PI. Além disso, foram observadas imagens de satélite da propriedade em 1985 e 2023, e calculado o percentual de todas as áreas de: APP, Reserva Legal - RL (Vegetação Nativa), Corpos d'água e Uso Consolidado, afim de julgar se há ou não necessidade de regularizar a instituição da Reserva Legal do Imóvel. Perante a análise da área de estudo, as leis que tangem a citada situação e os argumentos mencionados compreende-se que a Instituição de Reserva Legal nas proporções existentes na propriedade rural em questão, dispensa seus proprietários de procederem com qualquer recomposição e/ou compensação de vegetação, conforme Art. 68 do Código Florestal Brasileiro - Lei Federal. |
| Abstract: | The Brazilian Forest Code - Federal Law no. 12.651 introduces changes in the legislation, establishing general rules for Legal Reserve areas. The present work aimed to analyze the possibilities arising from the New Brazilian Forest Code for the regularization of the Legal Reserve area and problems related to the regularization of the Legal Reserve. In these terms, the objective of the project is to analyze a property of consolidated use present in the state of São Paulo, municipality of Itirapina, according to the determinations of the Forest Code. For the work, a study was made about the type of biome in the region and the requirements for the Legal Reserve, established by Federal Law 12.651/2012, so the percentage of legal reserve of the property in question was identified from the calculation of all areas present on the property. This study was conducted with the help of QGIS Desktop with Grass version 3.14 PI. In addition, satellite images of the property in 1985 and 2023 were observed, and the percentage of all areas of: APP, Legal Reserve - RL (Native Vegetation), Water Bodies and Consolidated Use, in order to judge whether or not there is a need to regularize the institution of the Legal Reserve of the Property. Faced with the analysis of the study area, the laws that touch on the aforementioned situation and the arguments mentioned, it is understood that the Legal Reserve Institution in the proportions existing in the rural property in question, exempts its owners from proceeding with any recomposition and/or compensation of vegetation, according to Art. 68 of the Brazilian Forest Code - Federal Law. |
