Aditivos contratuais de obras públicas: o caso do projeto padrão tipo B do programa proinfância

Abstract

In administrative law, contractual alterations to public works are institutionalized by law nº 8.666 of 1993 and are known as Contractual Additives. This paper aims to identify the main causes of contractual additives in public works. For this purpose, a case study about the standard type B project, belonging to the Proinfância program of the Federal Government, widely applied in several municipalities of Brazil will be used. This was done in two ways, one analyzing the historical database of the additives requested in the works already executed, present in the portal of the National Fund for Education Development, another analyzing the problems contained in the projects of the type B standard that would be possible to cause additives. As a result it has been observed that the causes of contractual additives of the b-type pattern lie in the lack of planning and in the loopholes of the federal legislation that allow this to happen.
